An Accra High Court would on June 15, hear an appeal on submission of no case filed by Nana Kofi Yirenkyi aka "Jesus One Touch", standing trial for allegedly defiling his 10-year-old daughter.
However, an Accra Circuit Court has ordered the accused to open his defence on Wednesday, June 16.
At the Circuit Court's sitting on Tuesday, it upheld that the appeal on submission of no case and stay of proceedings did not mean an automatic halt of proceedings before it.
The court said it could only grant the stay of proceedings if there were merits in the grounds of appeal and would therefore continue to hear the defence of the accused while he pursued the appeal at the High Court.
While Ms Helen Kwawukume, Chief State Attorney contended that the accused person's prayer to the court was delay proceedings, defence counsel was of the view that the court should wait until the appeal was heard.
"Jesus One Touch", who was to open his defence on Tuesday, May 11, disclosed through counsel that he would proceed to the High Court.
The appeal was against an Accra Circuit Court's ruling ordering the accused to open his defence.
Meanwhile, an application for stay of proceedings at the Circuit Court is also pending on an appeal at the High Court.
On April 26, this year, the prosecution closed its case after calling eight witnesses and the defence declared its intention to file a submission of no case.
Accused, who has pleaded not guilty to incest and defilement, has been remanded in police custody.
The Prosecution's case was that, the victim, born out of wedlock, lived with the complainant, Madam Bernice Owiredua Asamaa until 2005 when she left to live with the accused at McCarthy Hills in Accra to attend school.
It said between 2008 and 2009, accused started defiling the victim before he attended every church service.
In November 2009, the accused granted an opportunity to the victim's mother to talk to her because she was putting up a bad behaviour.
It was during the interaction that the victim revealed her ordeal to her mother.
The victim was initially examined by a medical doctor and later transferred to the Police Hospital for further treatment.
