An Accra Fast Track High Court on Tuesday acquitted and discharged a 22-year-old auto electrician apprentice for an alleged defilement.
Ruling on his appeal, the court noted that Seth Miller pleaded guilty to a non-existent offence.
The appellant was 20 years when convicted for allegedly defiling a 19-year-old girl in 2008.
Miller was sentenced to seven years imprisonment by an Accra Circuit Court for defilement.
The court noted that under the law, defilement could be said to have been committed to a girl under 16 years.
Miller had appealed at the High Court on the grounds that the sentence imposed on him was very harsh regarding the circumstances of the case.
According to the appellant, he had learnt his lesson and would not repeat the act and contended that he wanted to be released to take responsibility of victim's child.
The fact on which he was convicted was that the victim was a 19-year-old school drop-out staying with her grandmother at Aburi in the
Eastern Region, and Miller lived at Kitase, near Aburi.
The prosecution said the complainant was victim's father who also resided at Kitase, and the victim visited her father every week-end.
Sometime in September 2007, Miller was always seen with the victim and the victim's father warned him over their relationship.
It said Miller treated victim's father's warning with disrespect, rudeness and continued with his amorous relationship.
In January 2008, complainant detected that her daughter was pregnant and when she was questioned, she mentioned Miler as the person responsible.
Prosecution said a complaint was made at DOVVSU in Accra and a medical form was issued for the victim to attend hospital.
On February 2, 2008, Miller was arrested and during police interrogation, admitted the offence, and was charged after investigations.
